You may be able to get your Dallas County Misdemeanor case dismissed if;
1. You have NO criminal record.
2. The Misdemeanor in question is not a DWI, Family Violence Assault, or a Public
Lewdness Case.
3. “Memorandum of Agreement” MUST be signed by the Assistant District Attorney for Dallas County, you, and your attorney on the 1st court setting.
Deal Breakers
1. Failure to appear for a court setting.
2. Late for a court setting.
3. Failure to have a reasonable amount of items completed at the time of check-up.
4. Failure to complete agreements on time.
5. Any new charges.
Example of a check-up date
If the term of the agreement is 60 days for completion, the defendant will be back in court with his or her attorney in 30 days for a check-up. At that time the defendant will be required to have a “respectable” amount of the agreement completed.
If the agreement is, for example, a possession of marijuana case and the term of the agreement is 60 days for completion of 24 hours of community service, drug prevention class, and 2 clean urine tests 30 days apart, then at the time of the check-up
the defendant should have at least 8-12 hours of community service done, have one clean urine test, and be registered in a drug program if not already participating in a drug prevention class.
